Not really, but sorta. If would have to re-establish and file with New |
6 |
Mexico as a for profit. Seems the IRS just changes status from exempt, |
7 |
to non-exempt. |

Not really, but that problem could arise. Gentoo wasn't in existence |
15 |
legally back in 08. That was the first task the board back then |
16 |
accomplished. With me doing the final mailing into New Mexico. |

It will likely survive, but they have let this slide. This situation is |
23 |
100% a result of devrel, and a few other developers driving me away. |
24 |
Rather than staying out of the way, and letting me get tasks done, that |
25 |
clearly no one else has or will. |

The pentalities are that it becomes a for profit entity. Has to pay |
32 |
taxes for any years it did not file as for profit entity. Which means to |
33 |
pay back taxes, penalties, and any interest. That would likely |
34 |
immediately bankrupt Gentoo. Not that Gentoo needs money to exist. |
35 |

That is another matter, and the state did revoke the charter before. I |
39 |
do not recall any action thus far from the IRS. They tend to be rather |
40 |
behind on such things clearly. States tend to be behind as well, but |
41 |
dealing with smaller numbers, and tend to catch up before the IRS. |

Something along those lines, but they can't really take your business |
48 |
from you. Just make it impossible to remain in business, and drain all |
49 |
financial resources. |

Pretty sure nothing like that would happen, but I do not know enough to |
54 |
say for sure other way. This is new territory for me, and one I never |
55 |
wanted to have any knowledge or awareness of. |

Either way its a bit to late now. At least 3yrs have passed already. |
61 |
Things were not current or filed in 07, not sure about 06 or prior |
62 |
years. Gentoo needs to hire and retain someone to work on this matter |
63 |
ASAP before it gets any worse. |
64 |

Your welcome, but I have been telling others in private for some time. |
68 |
They failed to act, or take this seriously. I did not want to air |
69 |
Gentoo's dirty laundry in public. But thats the only way things to make |
70 |
anything happen clearly. |
71 |
|
72 |

74 |
You can thank devrel the CoC, and some other developers for that. I can |
75 |
name names, and its a very short list. But the impact of their damage is |
76 |
rather tremendous. Clear case of the pot calling the kettle black. |
77 |
|
78 |
Suspended me because I was supposedly being destructive. However they |
79 |
did considerably more damage in driving me away. Since I would have made |
80 |
sure all this was done. Which no one else has filled that void since. |
81 |
|
82 |
However I knew at the time I did not have the support or cooperation |
83 |
from other board members. I knew the treasurer should never have been |
84 |
such ever. But there was no way to make others realize that fact. Much |
85 |
less I got no support from the community as a whole, mostly the |
86 |
developer community. The situation just escalated, from me stepping down |
87 |
from the board, to me resigning as a developer. To years later stuff |
88 |
still not being done. |
89 |
|
90 |
Its very sad all around, and anyone who was involved before can pat |
91 |
themselves on the back for a job well done. Helping to really put |
92 |
Gentoo's NPO status in jeopardy, if not losing it for a period of time, |
93 |
and incurring substantial legal costs to get things in order. |
94 |
|
95 |
Yet it was my behavior on this very list long ago that got devrel |
96 |
involved and set Gentoo on the course its on to this day. Had devrel |
97 |
never suspended me, or other board members supported me and we replaced |
98 |
the treasurer in 08. Things would be very different then and now. |
99 |
|
100 |
Lessons learned the hard way, but it really did not have to be such! |
