Context is everything. Contextual elements here are open source and not-for-profit. The primary issue of by-laws depends on the relationship between a corporate entity and a group of people. There is a significant element of equivocation associated with the term person, which can refer to both a corporate entity and an individual man or woman. If equivocation results in the loss of legal status (capitis denintutio) from that of a man (who has sui juris status) to that of a corporate entity, a fraud exists. |
