Hi all

In preparation of the trademark / logo ownership transition I've drafted a
proposal on the use of the Gentoo name and logo outside Gentoo. I hope that
this proposal is in line with everybody's feelings.

"""
Disclaimer: This is a rough draft. It is a default setting that allows most
users to understand what can and cannot be tolerated. Exceptions
can be made on a case-by-case basis. Guidelines for exceptions
can be proposed.

The name "Gentoo" is not allowed within domain names.

The name "Gentoo" is not allowed within project/product names if they are
not official Gentoo projects/products.

Disclaimer: This cannot be enforced when the subject of the project/product
is no operating system or is not referring to the Gentoo project.

The Gentoo logo can be used when:
- it is accompanying Gentoo-related content while the logo itself is not
part of the main layout of the medium itself
- it is not the primary (largest) logo on the same side of the medium. A
possible guideline is 1/3rd of the size of the largest image
- it is displayed on non-commercial promotional material about the
Gentoo project which contains unmodified content from the Gentoo project

An exception can be made on a case-by-case basis for commercial purposes.
"""

I'll take some examples:

- The documentation website http://www.gentoo-wiki.com is using "Gentoo" in
it's domain name and the website is clearly about (or referring to)
Gentoo. It is therefore violating this draft but they can come to an
agreement with the Gentoo Foundation easily (for instance _clearly_
mentioning that the project is no official one)
- LiveCDs that are given away for promotional use can contain the Gentoo
name and logo as long as they are plain copies/burns of official LiveCDs
- T-Shirts with the Gentoo logo on it as a main logo cannot be sold (but
they can be given away at no costs), yet t-shirts that have a larger
logo on the same side of the t-shirt can be sold
- Websites that give news about Gentoo, or a WiKi explaining Gentoo, can
freely use our logo when it accompanies the Gentoo content

I believe such settings allow for the best containment of Gentoo's name and
logo usage without loosing the invaluable PR that can be achieved when the
name and logo is frequently used.

Thoughts?
