21 ORACLE AMERICA, INC. ("ORACLE"), FOR AND ON BEHALF OF ITSELF AND ITS
22 SUBSIDIARIES AND AFFILIATES UNDER COMMON CONTROL, IS WILLING TO LICENSE
23 THE SOFTWARE TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE
24 TERMS CONTAINED IN THIS BINARY CODE LICENSE AGREEMENT AND SUPPLEMENTAL
25 LICENSE TERMS (COLLECTIVELY "AGREEMENT"). PLEASE READ THE AGREEMENT
26 CAREFULLY. BY SELECTING THE "ACCEPT LICENSE AGREEMENT" (OR THE
27 EQUIVALENT) BUTTON AND/OR BY USING THE SOFTWARE YOU ACKNOWLEDGE THAT YOU

36 1. DEFINITIONS. "Software" means the Java SE Platform Products in binary
37 form that you selected for download, install or use from Oracle or its
38 authorized licensees, any other machine readable materials (including, but
39 not limited to, libraries, source files, header files, and data
40 files), any updates or error corrections provided by Oracle, and any user
41 manuals, programming guides and other documentation provided to you by
42 Oracle under this Agreement. "General Purpose Desktop Computers and
43 Servers" means computers, including desktop and laptop computers, or
44 servers, used for general computing functions under end user control
45 (such as but not specifically limited to email, general purpose Internet
46 browsing, and office suite productivity tools). The use of Software in
47 systems and solutions that provide dedicated functionality (other than as
48 mentioned above) or designed for use in embedded or function-specific
49 software applications, for example but not limited to: Software embedded
50 in or bundled with industrial control systems, wireless mobile telephones,
51 wireless handheld devices, netbooks, kiosks, TV/STB, Blu-ray Disc devices,
52 telematics and network control switching equipment, printers and storage
53 management systems, and other related systems are excluded from this
54 definition and not licensed under this Agreement. "Programs" means Java
55 technology applets and applications intended to run on the Java Platform,
56 Standard Edition platform on Java-enabled General Purpose Desktop
57 Computers and Servers. "Commercial Features" means those features
58 identified in Table 1-1 (Commercial Features In Java SE Product Editions)
59 of the Software documentation accessible at
60 http://www.oracle.com/technetwork/java/javase/documentation/index.html.
61 "README File" means the README file for the Software accessible at
62 http://www.oracle.com/technetwork/java/javase/terms/readme/index.html.

64 2. LICENSE TO USE. Subject to the terms and conditions of this
65 Agreement including, but not limited to, the Java Technology
66 Restrictions of the Supplemental License Terms, Oracle grants you a
67 non-exclusive, non-transferable, limited license without license fees to
68 reproduce and use internally the Software complete and unmodified for the
69 sole purpose of running Programs. THE LICENSE SET FORTH IN THIS SECTION
70 2 DOES NOT EXTEND TO THE COMMERCIAL FEATURES. YOUR RIGHTS AND OBLIGATIONS
71 RELATED TO THE COMMERCIAL FEATURES ARE AS SET FORTH IN THE SUPPLEMENTAL
72 TERMS ALONG WITH ADDITIONAL LICENSES FOR DEVELOPERS AND PUBLISHERS.

74 3. RESTRICTIONS. Software is copyrighted. Title to Software and all
75 associated intellectual property rights is retained by Oracle and/or its
76 licensors. Unless enforcement is prohibited by applicable law, you may
77 not modify, decompile, or reverse engineer Software. You acknowledge that
78 the Software is developed for general use in a variety of information
79 management applications; it is not developed or intended for use in any
80 inherently dangerous applications, including applications that may create
81 a risk of personal injury. If you use the Software in dangerous
82 applications, then you shall be responsible to take all appropriate
83 fail-safe, backup, redundancy, and other measures to ensure its safe use.
84 Oracle disclaims any express or implied warranty of fitness for such
85 uses. No right, title or interest in or to any trademark, service mark,
86 logo or trade name of Oracle or its licensors is granted under this
87 Agreement. Additional restrictions for developers and/or publishers
88 licenses are set forth in the Supplemental License Terms.

90 4. DISCLAIMER OF WARRANTY. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT
91 WARRANTY OF ANY KIND. ORACLE FURTHER DISCLAIMS ALL WARRANTIES, EXPRESS
92 AND IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF
93 MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.

95 5. LIMITATION OF LIABILITY. IN NO EVENT SHALL ORACLE BE LIABLE FOR ANY
96 INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR
97 DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR DATA USE, INCURRED BY YOU OR
98 ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF ORACLE
99 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ORACLE'S ENTIRE
100 LIABILITY FOR DAMAGES HEREUNDER SHALL IN NO EVENT EXCEED ONE THOUSAND
101 DOLLARS (U.S. $1,000).

103 6. TERMINATION. This Agreement is effective until terminated. You may
104 terminate this Agreement at any time by destroying all copies of
105 Software. This Agreement will terminate immediately without notice from
106 Oracle if you fail to comply with any provision of this Agreement.
107 Either party may terminate this Agreement immediately should any Software
108 become, or in either party's opinion be likely to become, the subject of a
109 claim of infringement of any intellectual property right. Upon
110 termination, you must destroy all copies of Software.

112 7. EXPORT REGULATIONS. You agree that U.S. export control laws and
113 other applicable export and import laws govern your use of the Software,
114 including technical data; additional information can be found on Oracle's
115 Global Trade Compliance web site (http://www.oracle.com/products/export).
116 You agree that neither the Software nor any direct product thereof will be
117 exported, directly, or indirectly, in violation of these laws, or will be
118 used for any purpose prohibited by these laws including, without
119 limitation, nuclear, chemical, or biological weapons proliferation.

121 8. TRADEMARKS AND LOGOS. You acknowledge and agree as between you
122 and Oracle that Oracle owns the ORACLE and JAVA trademarks and all ORACLE-
123 and JAVA-related trademarks, service marks, logos and other brand
124 designations ("Oracle Marks"), and you agree to comply with the Third
125 Party Usage Guidelines for Oracle Trademarks currently located at
126 http://www.oracle.com/us/legal/third-party-trademarks/index.html. Any use
127 you make of the Oracle Marks inures to Oracle's benefit.

129 9. U.S. GOVERNMENT LICENSE RIGHTS. If Software is being acquired by or
130 on behalf of the U.S. Government or by a U.S. Government prime contractor
131 or subcontractor (at any tier), then the Government's rights in Software
132 and accompanying documentation shall be only those set forth in this
133 Agreement.

135 10. GOVERNING LAW. This agreement is governed by the substantive and
136 procedural laws of California. You and Oracle agree to submit to the
137 exclusive jurisdiction of, and venue in, the courts of San Francisco, or
138 Santa Clara counties in California in any dispute arising out of or
139 relating to this agreement.

141 11. SEVERABILITY. If any provision of this Agreement is held to be
142 unenforceable, this Agreement will remain in effect with the provision
143 omitted, unless omission would frustrate the intent of the parties, in
144 which case this Agreement will immediately terminate.

146 12. INTEGRATION. This Agreement is the entire agreement between you and
147 Oracle relating to its subject matter. It supersedes all prior or
148 contemporaneous oral or written communications, proposals,
149 representations and warranties and prevails over any conflicting or
150 additional terms of any quote, order, acknowledgment, or other
151 communication between the parties relating to its subject matter during
152 the term of this Agreement. No modification of this Agreement will be
153 binding, unless in writing and signed by an authorized
154 representative of each party.

156 SUPPLEMENTAL LICENSE TERMS

158 These Supplemental License Terms add to or modify the terms of the
159 Binary Code License Agreement. Capitalized terms not defined in these
160 Supplemental Terms shall have the same meanings ascribed to them in the
161 Binary Code License Agreement. These Supplemental Terms shall supersede
162 any inconsistent or conflicting terms in the Binary Code License
163 Agreement, or in any license contained within the Software.

165 A. COMMERCIAL FEATURES. You may not use the Commercial Features for
166 running Programs, Java applets or applications in your internal business
167 operations or for any commercial or production purpose, or for any
168 purpose other than as set forth in Sections B, C, D and E of these
169 Supplemental Terms. If You want to use the Commercial Features for any
170 purpose other than as permitted in this Agreement, You must obtain a
171 separate license from Oracle.

173 B. SOFTWARE INTERNAL USE FOR DEVELOPMENT LICENSE GRANT. Subject to the
174 terms and conditions of this Agreement and restrictions and exceptions set
175 forth in the README File incorporated herein by reference, including, but
176 not limited to the Java Technology Restrictions of these Supplemental
177 Terms, Oracle grants you a non-exclusive, non-transferable, limited
178 license without fees to reproduce internally and use internally the
179 Software complete and unmodified for the purpose of designing, developing,
180 and testing your Programs.

182 C. LICENSE TO DISTRIBUTE SOFTWARE. Subject to the terms and conditions
183 of this Agreement and restrictions and exceptions set forth in the
184 README File, including, but not limited to the Java Technology
185 Restrictions of these Supplemental Terms, Oracle grants you a
186 non-exclusive, non-transferable, limited license without fees to reproduce
187 and distribute the Software, provided that (i) you distribute the
188 Software complete and unmodified and only bundled as part of, and for the
189 sole purpose of running, your Programs, (ii) the Programs add significant
190 and primary functionality to the Software, (iii) you do not distribute
191 additional software intended to replace any component(s) of the Software,
192 (iv) you do not remove or alter any proprietary legends or notices
193 contained in the Software, (v) you only distribute the Software subject to
194 a license agreement that: (a) is a complete, unmodified reproduction of
195 this Agreement; or (b) protects Oracle's interests consistent with the
196 terms contained in this Agreement and that includes the notice set forth
197 in Section G, and (vi) you agree to defend and indemnify Oracle and its
198 licensors from and against any damages, costs, liabilities, settlement
199 amounts and/or expenses (including attorneys' fees) incurred in
200 connection with any claim, lawsuit or action by any third party that
201 arises or results from the use or distribution of any and all Programs
202 and/or Software.

204 D. LICENSE TO DISTRIBUTE REDISTRIBUTABLES. Subject to the terms and
205 conditions of this Agreement and restrictions and exceptions set forth in
206 the README File, including but not limited to the Java Technology
207 Restrictions of these Supplemental Terms, Oracle grants you a
208 non-exclusive, non-transferable, limited license without fees to
209 reproduce and distribute those files specifically identified as
210 redistributable in the README File ("Redistributables") provided that:
211 (i) you distribute the Redistributables complete and unmodified, and only
212 bundled as part of Programs, (ii) the Programs add significant and primary
213 functionality to the Redistributables, (iii) you do not distribute
214 additional software intended to supersede any component(s) of the
215 Redistributables (unless otherwise specified in the applicable README
216 File), (iv) you do not remove or alter any proprietary legends or notices
217 contained in or on the Redistributables, (v) you only distribute the
218 Redistributables pursuant to a license agreement that: (a) is a complete,
219 unmodified reproduction of this Agreement; or (b) protects Oracle's
220 interests consistent with the terms contained in the Agreement and
221 includes the notice set forth in Section G, (vi) you agree to defend and
222 indemnify Oracle and its licensors from and against any damages, costs,
223 liabilities, settlement amounts and/or expenses (including attorneys'
224 fees) incurred in connection with any claim, lawsuit or action by any
225 third party that arises or results from the use or distribution of any
226 and all Programs and/or Software.

228 E. DISTRIBUTION BY PUBLISHERS. This section pertains to your
229 distribution of the JavaTM SE Development Kit Software with your printed
230 book or magazine (as those terms are commonly used in the industry)
231 relating to Java technology ("Publication"). Subject to and conditioned
232 upon your compliance with the restrictions and obligations contained in
233 the Agreement, Oracle hereby grants to you a non-exclusive,
234 nontransferable limited right to reproduce complete and unmodified copies
235 of the Software on electronic media (the "Media") for the sole purpose of
236 inclusion and distribution with your Publication(s), subject to the
237 following terms: (i) You may not distribute the Software on a stand-alone
238 basis; it must be distributed with your Publication(s); (ii) You are
239 responsible for downloading the Software from the applicable Oracle web
240 site; (iii) You must refer to the Software as JavaTM SE Development Kit;
241 (iv) The Software must be reproduced in its entirety and without any
242 modification whatsoever (including with respect to all proprietary
243 notices) and distributed with your Publication subject to a license
244 agreement that is a complete, unmodified reproduction of this Agreement;
245 (v) The Media label shall include the following information: Copyright
246 2011, Oracle America, Inc. All rights reserved. Use is subject to
247 license terms. ORACLE and JAVA trademarks and all ORACLE- and
248 JAVA-related trademarks, service marks, logos and other brand
249 designations are trademarks or registered trademarks of Oracle in the
250 U.S. and other countries. This information must be placed on the Media
251 label in such a manner as to only apply to the Oracle Software; (vi) You
252 must clearly identify the Software as Oracle's product on the Media
253 holder or Media label, and you may not state or imply that Oracle is
254 responsible for any third-party software contained on the Media; (vii) You
255 may not include any third party software on the Media which is intended
256 to be a replacement or substitute for the Software; (viii) You agree to
257 defend and indemnify Oracle and its licensors from and against any
258 damages, costs, liabilities, settlement amounts and/or expenses
259 (including attorneys' fees) incurred in connection with any claim,
260 lawsuit or action by any third party that arises or results from the use
261 or distribution of the Software and/or the Publication; ; and (ix) You
262 shall provide Oracle with a written notice for each Publication; such
263 notice shall include the following information: (1) title of Publication,
264 (2) author(s), (3) date of Publication, and (4) ISBN or ISSN numbers.
265 Such notice shall be sent to Oracle America, Inc., 500 Oracle Parkway,
266 Redwood Shores, California 94065 U.S.A , Attention: General Counsel.

268 F. JAVA TECHNOLOGY RESTRICTIONS. You may not create, modify, or change
269 the behavior of, or authorize your licensees to create, modify, or change
270 the behavior of, classes, interfaces, or subpackages that are in any way
271 identified as "java", "javax", "sun", "oracle" or similar convention
272 as specified by Oracle in any naming convention designation.

274 G. COMMERCIAL FEATURES NOTICE. For purpose of complying with
275 Supplemental Term Section C.(v)(b) and D.(v)(b), your license agreement
276 shall include the following notice, where the notice is displayed in a
277 manner that anyone using the Software will see the notice:

279 Use of the Commercial Features for any commercial or production purpose
280 requires a separate license from Oracle. "Commercial Features" means

285 H. SOURCE CODE. Software may contain source code that, unless
286 expressly licensed for other purposes, is provided solely for reference
287 purposes pursuant to the terms of this Agreement. Source code may not be

290 I. THIRD PARTY CODE. Additional copyright notices and license terms
291 applicable to portions of the Software are set forth in the
292 THIRDPARTYLICENSEREADME file accessible at

294 In addition to any terms and conditions of any third party
295 opensource/freeware license identified in the THIRDPARTYLICENSEREADME
296 file, the disclaimer of warranty and limitation of liability provisions
297 in paragraphs 4 and 5 of the Binary Code License Agreement shall apply to
298 all Software in this distribution.

300 J. TERMINATION FOR INFRINGEMENT. Either party may terminate this
301 Agreement immediately should any Software become, or in either party's
302 opinion be likely to become, the subject of a claim of infringement of any
303 intellectual property right.

305 K. INSTALLATION AND AUTO-UPDATE. The Software's installation and
306 auto-update processes transmit a limited amount of data to Oracle (or its
307 service provider) about those specific processes to help Oracle
308 understand and optimize them. Oracle does not associate the data with
309 personally identifiable information. You can find more information
310 about the data Oracle collects as a result of your Software download at
311 http://www.oracle.com/technetwork/java/javase/documentation/index.html.
