19 There is an EU directive on Data Retention (and a new EU Regulation being
20 drafted), which prohibits transfer of personal data outside of the European
21 Economic Area (EEA), unless specific measures are taken to ensure an adequate
22 level of privacy (the adequacy requirement). Every time a new revelation
23 about spying on our communications and data takes place, this level of
24 adequacy is consequently notched up.

34 This applies across the EU, not just Germany. BTW, under the current Data
35 Retention Directive the 'data controller' can decide if a 3rd party data
36 provider is 'safe', but once the Regulation is enacted in 2017 onwards only
37 the EU Commission can do so. This is probably to avoid cases where privacy
38 rights activists (e.g. Digital Rights Ireland) sued their governments for
39 spying on their personal data, consequently rendering the Directive invalid -
40 but I am not sure.
