There is an EU directive on Data Retention (and a new EU Regulation being |

drafted), which prohibits transfer of personal data outside of the European |

Economic Area (EEA), unless specific measures are taken to ensure an adequate |

level of privacy (the adequacy requirement). Every time a new revelation |

about spying on our communications and data takes place, this level of |

adequacy is consequently notched up. |

This applies across the EU, not just Germany. BTW, under the current Data |

Retention Directive the 'data controller' can decide if a 3rd party data |

provider is 'safe', but once the Regulation is enacted in 2017 onwards only |

the EU Commission can do so. This is probably to avoid cases where privacy |

rights activists (e.g. Digital Rights Ireland) sued their governments for |

spying on their personal data, consequently rendering the Directive invalid - |

but I am not sure. |
