24 I'm pretty skeptical that anything strong will be found, but I'm not
25 opposed to asking. Lawyers aren't really the last word though, and
26 they tend to be risk-averse. If we stopped distributing Gentoo
27 entirely then we'd be less likely to be sued for copyright violation,
28 for example. So, I wouldn't avoid something simply because of a
29 hypothetical risk - risk needs to be weighed against benefit.

37 I'm not sure I claimed that they are. I already said that if we were
38 spending Gentoo money on services like Github it might be more
39 problematic because arguably the contributors did not intend for the
40 money to be spent in that manner. On the other hand, contributions
41 made after we made some announcement that we're officially using
42 Github would arguably not be as much of a problem, since contributors
43 would have had access to this information before they contributed.

45 In any case, I think that we should be concerned about the Social
46 Contract because that is a big part of what we're about. I suspect
47 we're already being a lot harder on ourselves than any court is likely
48 to be. Look at how a typical big US non-profit like the Red Cross
49 spends its money and try to tell me with a straight face that we're
50 doing a worse job of adhering to our mission.
